Q. How many properties are on the development?

Q. Who are the shareholders of the Company?

The company does not have shareholders. It is a not for profit company and has members only


Q. Why am I obliged to pay the maintenance charge?

By signing the deeds of your property you agreed to pay the annual charge and this is a legal obligation.


Q. Who owns the amenity areas?

The owner is Vista Road (Newton Le Willows) Management Company Limited and this is registered as such with the Land Registry.


Q. To what standard must the open spaces be kept?

The central park must conform to the Landscape Management Plan and it should be regularly inspected by the local council to ensure that it is being kept to the required standard. We do not have a plan for the other two areas.

 

Q. What happens if the open spaces are not kept to the standard required?

The Council could issue an enforcement notice and ultimately may take the residents to court.


Q. Will it be possible for the amenity areas to be altered in the future by the addition of tennis courts, lighting or other facilities?

This would not be possible. The responsibility of the Vista Road (Newton Le Willows) Management Company Limited is to maintain the areas to the standard set out in the Landscape Management Plan.


Q. Is possible to purchase any of the land?

It is not possible for anyone to buy any of the land from the Company. In addition if any person fences off any part of the land or builds any structure on the land it is the responsibility of the Company to remove these and re-instate the boundaries.


Q. What are the rules of the company?

The Company rules are contained in the Memorandum and Articles of Association. These are available from Companies House or as a download from this website.


Q. Can I refuse to pay the annual charge if I am not satisfied with the Management Company?

Payment of the annual charge is a mandatory requirement and it cannot be withheld for any reason. If you are a homeowner you are a member of the Company and as such you have a joint responsibility for the actions of the Company.


Q. What should I do if I run into financial difficulty and cannot pay the annual charge?

Please contact our accountants and explain the situation as soon as possible so that an agreement can be reached that takes your circumstances into account.


Q. Why don’t we ask the council to adopt the land?

In 2010, before the land was handed over to the Company, the local council agreed to adopt the amenity areas. They asked Taylor Wimpey for a one off sum of £102,000 for this. However the council later withdrew the offer due to local authority cutbacks. It is unlikely that they would make this offer again. If they did, it would be necessary to have the agreement of all Members and to change the transfer deeds of all properties.


Q. Does the Company have any involvement when a house is bought or sold?

Yes. When a house is being sold the solicitors from both sides make enquiries about the Management Company. These are dealt with by our accountant (PA Hull & Co)and we charge a fee for the administration work involved, which is common practice. The Land Registry requires a letter of permission from the Management Company before a land transfer can be registered. Since we took over running the management company our aim has always been to keep costs down and the directors decided that £50 would be a reasonable one-off sum for the buyer and seller.


Q. The Company is holding up my house sale. What can I do to speed things up?

Provided Solicitors make enquiries of the Management Company in good time there should never be any delay. In the event of a problem please email us. All emails are answered. In an emergency please phone PA Hull & Co  direct since this is the company that carries out the work on our behalf. You can use one of the telephone numbers shown on all of these pages.


Q. Are the company accounts audited?

No. We opted not to have the accounts audited.


Q. How do I obtain a copy of the accounts?

Please email us and we will send these to you - if you are a member.


Q. Do PA Hull charge the Company if an invoice or a follow up letter is sent in error?

No. A flat fee is agreed for sending out batches of invoices and follow up letters.


Q, When I try to set up the payment with my bank, a match cannot be found.

Some banks don't recognise the account name that is shown on the invoices. In that case please use the name "HINDLEIGH ACCOUNTANCY SVCS LTD" The account number and sort code shown on the invoice are correct.


Q. Why is an estimate of expenditure not prepared as mentioned by the Fifth Schedule of the Transfer Deeds?

The expenditure is similar every year so it is considered that time taken to prepare and issue an estimate is unnecessary. Also if we posted our estimate on this website then contractors would know our budget when bidding for work.


Q. Why is interest not charged on unpaid invoices after 21 days as mentioned by the Fifth Schedule of the Transfer Deeds?

We considered that this was unreasonable and we allow a longer period to settle invoices before any action is taken. We reserve the right to charge interest on invoices after 21 days from issue in the case of late payment.


Q. Why is the address of PA Hull shown as their Earlestown office when some work is done from their Hindley office?

The Earlestown office is the registered address of the company. We believe that members prefer to be able to pop into the local office rather than travel to Hindley. Telephone calls made to the Earlestown office can be transferred to the relevant person in Hindley. Members may also visit the Hindley office which is at Beech House, 23, Ladies Lane, Hindley, WN2 2QA. Telephone 01942 737375


Q. Why is the invoice number used as a reference for payments rather that the Member ID?

The invoice number is a unique number that identified the particular invoice.


Q. Is the Management Company responsible for the roads and pavements or anything to do with the houses?

No. we are only responsible for the maintenance of the amenity areas.
